HMC Electrics applied under s.170MH of the pre-reform Workplace Relations Act 1996 for termination of the HMC Electrics - CEPU Enterprise Agreement 2003-2005 in the public interest in order to be Code compliant. The applicant was represented by MBAV.
The application was filed with the AIRC on 6 March 2007 in respect of an agreement which had passed its nominal expiry date.
AIRC proceedings took place on 27 March 2007. The ABCC supported the submissions of the employer that it would not be contrary to the public interest if the AIRC terminated the agreement. Deputy President Ives ruled that it would not be contrary to the public interest to terminate the agreement and ordered that it be terminated.
