Delta Pty Ltd applied to the AIRC to terminate an expired certified agreement under s.170MH of the pre-reform Workplace Relations Act. The agreement was not compliant with the National Code of Practice.

CFMEU consented to termination after Notice of Intervention filed by ABCC. The relevant employees of Delta Pty Ltd also consented to the termination of the agreement.
