Corke Instrument Engineering (Australia) Pty Ltd applied for review of a decision of the Electrical Contracting Disputes Board (the Board) under s170LW of the Workplace Relations Act 1996 (pre – reform), regarding work on construction of a gas plant at Port Campbell in Victoria.
Corke Instrument Engineering workers walked off the job on 1 May 2006 following a toilet leak which disrupted access to their amenities although discussions between the company and the union’s OHS representative were still taking place.
The Board had ruled that employees should not lose pay for having left the site without approval.
The ABCC intervened and filed written submissions. However before the scheduled hearing dates, on 22 June the AIRC was advised that the CEPU no longer sought to enforce the decision of the Board. Accordingly, the Corke Instrument Engineering withdrew its application to the AIRC.
