The CFMEU applied for leave to appeal the decision of Commissioner Hoffman to issue orders under s.127 of the WRA.

Following a hearing on 23 January 2006, the Full Bench of the AIRC determined that it was not persuaded that it was a proper case for a grant of leave to appeal and accordingly it refused leave to appeal.
