The CEPU is seeking to negotiate a union collective agreement with Wilken Electrical Services Pty Ltd and applied to the Commission for an Order for a Protected Action Ballot.
At the hearing on 9 October 2006, Wilken challenged the union’s application on a number of grounds including that the union had only within the last week provided Wilken with a draft agreement which was free of prohibited content and did not breach the National Code of Practice for the Construction Industry and Implementation Guidelines.
Commissioner Harrison granted the union’s application and made a protected action ballot order on the grounds that the requirements of the Workplace Relations Act 1996 had been met.
