The National Electrical and Communications Association (NECA) and the Electrical Trades Union (ETU) finalised a standardised framework agreement for electrical contractors in January 2011. The first electrical contractor to seek approval of its proposed enterprise agreement based on the framework agreement, ADJ Contracting Pty Ltd, submitted it to Fair Work Australia (FWA) for approval.

The ABCC made a submission to FWA arguing that a number of provisions of the ADJ Contracting Pty Ltd agreement, which is based on the deal struck between the ETU and NECA earlier this year, may contravene sections of the Fair Work Act 2009 (FW Act). Acton Electrical has submitted an agreement to FWA for approval. The ABCC has, among other things, proposed that consideration of this agreement not occur until FWA’s decision in the ADJ Contracting matter.
