A-Line Partitions applied to the AIRC under s.170MH of the Workplace Relations Act 1996 (pre reform) for termination of the A-Line partitions Holdings Pty Ltd and CFMEU Building and Construction Industry Collective Bargaining Agreement 2002-2005, a certified agreement which had passed its nominal expiry date.

A-Line Partitions sought termination in order to ensure that its industrial instruments complied with the national Code of Practice for the Construction Industry.

The ABCC Commissioner intervened in the matter and made submissions in support of the case for termination.

Senior Deputy President Watson ruled it would not be contrary to the public interest to terminate the agreement and ordered that it be terminated.
