Background:

Becon Constructions was the head contractor on the Woolworths supermarket complex in Beaconsfield.

CFMEU official Fergal Doyle attended the site on 22 May 2009 to inspect alleged contraventions of the Occupational Health and Safety Act 2004 (Vic) (OHS Act). Mr Doyle did not hold an entry permit at this time.

Mr Doyle told the site supervisor he did not have to show his permit and that Becon’s right of entry protocols were wrong. On 22 May 2009, Mr Doyle entered the site twice.

The ABCC alleges that Mr Doyle and the CFMEU contravened the Workplace Relations Act 1996 twice because Mr Doyle failed to hold a permit required for OHS entry and misrepresented his right to enter the Woolworths site.
