Outcome:

On 8 June 2010 the Federal Magistrates Court in Brisbane imposed penalties totalling $8800 on Mr Carter for acting in an improper manner and misrepresenting his rights as a permit holder. Written reasons and judgment were issued on 6 July 2010.

Background:

In December 2008 Mr Wayne Carter, an officer of the Construction, Forestry, Mining and Energy Union (CFMEU), provided an entry notice to Procast Australia Pty Ltd at a site in Heathwood, Queensland. The entry notice claimed to conform with the requirements of the Workplace Relations Act 1996. The following day Mr Carter entered the Heathwood site and attempted to talk to the workers. After being asked to leave Mr Carter allegedly assaulted an employee of Procast twice and refused to leave the site.
