Outcome:

On 5 August 2010 the Federal Court imposed $67,500 in penalties on the AMWU, AWU, CFMEU, CEPU and officials Greg Warren, Terry Lee, Peter Mooney and John Parker, for organising and attending protest action to pressure subcontractors into entering union agreements.

Background:

Worley Parsons was the head contractor on the Patricia Baleen gas plant in Newmerella, near Orbost, in Victoria’s Gippsland region.

Worley Parsons engaged a number of subcontractors who had site specific workplace agreements in place with their employees, but unions were not party to these agreements.

From November 2008 until April 2009 the ABCC alleges that the respondents engaged in an industrial campaign including work bans and pickets in an attempt to force the subcontractors to replace their existing workplace agreements with union workplace agreements.
