Outcome:

On 27 June 2011, the court imposed penalties totalling $110,000 on the CFMEU and four of its officials, for disrupting work at the Royal Children’s Hospital and other sites across Melbourne to protest the swipe-card security system utilised by Bovis Lend Lease.

Background:

Bovis Lend Lease Pty Ltd (BLL) engaged Caelli Constructions (Vic) Pty Ltd to perform building works at four sites across Melbourne including: the New Royal Children's Hospital site in Parkville, Myer, Montage and ANZ projects in Docklands.

The ABCC alleged that between 15 October and 11 December 2008 five CFMEU Officials procured unlawful industrial action in breach of s 38 of the BCII Act and failed to comply with an order of the AIRC and acted in an improper manner while exercising rights as a permit holder in breach of s 767 of the WR Act.
