Outcome:

On 1 September 2011 Neville FM handed imposed penalties of $21,000 on the first respondent for two contraventions of s.357(1) of the Fair Work Act 2009 , $1500 on the first respondent for contravening the relevant awards, and $1500 on the second respondent for contravening s.900(1) of the Workplace relations Act 1996.

Background:

The ABCC alleged that Rapid Formwork Constructions Pty Ltd and its director, Kevin Anderson contravened s900 and s901(1) of the Workplace Relations Act 1996  and s357(1) of the Fair Work Act 2009 by misrepresenting the terms and conditions of employment of two hired formworkers.

The ABCC further alleged that by failing to pay the second formworker correct entitlements Mr Anderson and Rapid Formwork contravened the Building and Construction Industry (ACT) Award 2002 and the Building and Construction General On-Site Award 2010 (Modern Award).
