ABCC v Graauwmans and CFMEU

Directions were given on 9 November 2011. A half day Penalty Hearing was scheduled 16 April 2012. On 19 April 2012, the Federal Court of Australia penalised the CFMEU $30,000, and Mr Graauwmans an additional $5,000.

Background:

The ABCC alleges that on 24 June 2010 CFMEU Official Robert Graauwmans conducted a meeting outside the site of the Barwon Heads Redevelopment Project at Barwon Heads, Victoria.  In that meeting Mr Graauwmans informed employees that the CFMEU was concerned subcontractor employees were being paid under the Modern Award.

Following the meeting, Mr Graauwmans allegedly informed the head contractor that the workers had passed a vote, resolving to walk off the site at any time employees of that subcontractor were working on site.

On 17 August 2010 employees of the subcontractor returned to the site to perform work on the project.  The ABCC alleges Mr Graauwmans held another meeting at the site, and following that meeting the employees failed to perform any work on the project for the remainder of that day.
