ABCC v Doyle and CFMEU

The CFMEU admitted contravening section 500 of the Fair Work Act.  On 14 December 2011 the Court imposed agreed penalties totalling $13,000.

Background:

The ABCC alleges that at about 1.45pm on 19 October 2009, CFMEU official Fergal Doyle entered a construction site at the Mossgiel Park Primary School site without prior notice.

Mr Doyle entered the site to investigate suspected contraventions of the Victorian Occupational Health and Safety Act 2007. This was a lawful reason to enter the site.

Mr Doyle refused to attend the site office to sign in and refused to show the site manager his entry permit. The site manager contacted Victoria Police and the ABCC before again asking Mr Doyle to show his entry permit. Mr Doyle refused the request.

While attending the site Mr Doyle pulled three power cords out of their sockets and directed several steelfixers and concreters working at the site to sit in the sheds while he ascertained if the site was safe.
